- Meet at least 3 of 10 regulatory criteria
- Published material about you in professional publications
- Evidence of original contributions of major significance
- High salary or remuneration relative to peers
EB-2 NIW: National Interest Waiver
Self-PetitionAllows professionals with advanced degrees or exceptional ability to self-petition without employer sponsorship by demonstrating their work benefits the national interest.
Key Requirements
- Advanced degree (Master's or higher) OR exceptional ability
- Proposed endeavor has substantial merit and national importance
- Well-positioned to advance the proposed endeavor
- On balance, beneficial to waive the job offer requirement
EB-3: Skilled Workers & Professionals
Employer SponsoredFor professionals with bachelor's degrees or skilled workers with at least 2 years of training or experience. Requires employer sponsorship and PERM labor certification.

- Valid job offer from a U.S. employer
- PERM Labor Certification approved
- Bachelor's degree or 2+ years specialized experience
- Employer must demonstrate inability to find qualified U.S. workers
